What charges would be against this fictional character? And what immediate punishment would be administered?

I'm writing a novel and need to know what would happen if my fictional character, Lindsey, cut the brakes of a car belonging to another fictional character, Bryant. Because the brakes are cut a collision occurs and Bryant ends up in ICU. No one dies, but there is major damage to both vehicles involved.





What charges would be against Lindsey? And what immediate punishment would be administered?|||No immediate punishment. Chance, upon conviction, of no jail or prison time at all.


If she does not plead guilty to the attempt murder (which is the charge I would seek if I was the investigating detective) then it is likely that the trial would not happen for at least 6 to 9 months.


If found guilty on all counts (attempt murder, aggravated battery, criminal mischief, damage to property) the judge still would not sentence her until there was a check done by social services. usually a month more.


It is likely she would have spent only overnight in jail or lockup if she could post bond. What her bond would be depends on a lot of factors.





In my jurisdiction, a busy one, if she has no past record and the victim is not related then there is a decent chance of felony probation for 2 to 5 years and a $5000 fine. Depending on circumstances she can get up to 10 years in my state.





If domestic related there is a good chance everything gets doubled and much more likely she goes to prison for at least a couple of years before being allowed out on parole.|||"Every one who commits mischief that causes actual danger to life is guilty of an indictable offence and liable to imprisonment for life."



Canadian Law anyways. %26gt;.%26gt; I don't know american laws...|||Attempted murder...since it was premeditated. Then there would be reckless endangerment (towards both parties), assault with intent to do grave bodily harm...so probably 1st degree assault. Not sure what the actual punishment would be as the DA's would file charges and then there would be a bunch of legal wrangling and she would also most likely cop a plea so she wouldn't have to serve full time on all charges..
